Privacy notice — Personal Data Protection Act 2010
The Personal Data Protection Act 2010 (“PDPA”), which came into force on 15 November 2013, regulates the processing and collection of personal data by data users in commercial transactions and safeguards the interests of data subjects.
We, MOMAwater Sdn. Bhd. (Company No. 201301003406 (1033245-V)) and our subsidiaries, related and associated companies (collectively “MOMA”, “we”, “us” or “our”), are committed to the protection of your personal information when you use any MOMA website. In compliance with the PDPA, we have taken the necessary steps to meet data-privacy requirements by providing this privacy statement, outlining how your personal information is collected and used by us.
Please read this statement to understand how we use the personal information we may collect from you. By providing your personal information to us, you consent to this statement and to the collection, use, access, transfer, storage and processing of your personal information as described here. MOMA reserves the right to amend any portion of this statement from time to time.
Definitions
For the purpose of this statement:
- “MOMA”, “us”, “we” or “our” means MOMAwater Sdn. Bhd. and/or our subsidiaries, associated companies and/or any entity forming part of MOMA, and includes our agents, employees, contractors and sub-contractors.
- “Personal information” means any personal information or data of a living individual which relates directly or indirectly to you, including any information that can be used to identify or distinguish you — for example your name, identity card or passport number, address and contact number. Personal information also includes the sensitive personal information of the individual.
- “Sensitive personal information” means personal information consisting of information as to physical or mental health condition or disability, political opinion, religious or other similar beliefs, the commission or alleged commission of any offence, criminal records, or any other personal data determined by law to be sensitive.
1. Collection of personal information
Pursuant to the requirements of the PDPA, we issue this notice to all our valued customers and prospective customers. We only collect personally identifiable information about you if you choose to give it to us. In the course of dealings between you and MOMA, you may be requested to provide personal data to be collected, retained, shared, used and processed for purposes in respect of our products and/or services.
On this website specifically, you can browse without giving us anything: we collect analytics data only if you accept cookies (see the cookie table below), and we process the details you choose to send us — such as your name, company and email — when you make a trade enquiry or write to us.
The personal data collected by us may include, but is not limited to:
- name, occupation and company name;
- age, gender, date of birth, national registration identity card number, passport number;
- race, ethnic origin, nationality;
- contact information, including private and/or business address, email address and telephone or mobile phone number;
- marital status, details of children, income range, employer; and
- such other relevant information.
2. Purposes for which your personal data is collected
The purposes for which your personal data is used depend on the circumstances in which it is collected. Generally, your personal data is collected, retained, shared, used, disclosed and/or processed by us for, amongst others, the following purposes:
- the purpose for which you provided it to us;
- purposes which are directly related to the purpose for which you provided it to us;
- internal record keeping;
- employment opportunities, in the event you have provided information for such purposes;
- engaging in business transactions in respect of products and/or services to be offered and provided to you;
- marketing and promotional activities, market surveys, trend and statistical analysis;
- keeping in contact with you and providing you with any information you request (for example, answering any queries and dealing with any complaints and feedback);
- maintaining records required for security, claims or other legal purposes;
- complying with legal and regulatory requirements; and
- all other purposes in relation or incidental to the above that are required or permitted by any law, regulations, guidelines and/or relevant regulatory authorities.
3. Disclosing your personal data
Your personal data is kept confidential. However, we may be required or need to disclose information about you to the following categories of parties:
- any related, associated or affiliated companies and subsidiaries of MOMA;
- auditors, consultants, lawyers, accountants or other financial or professional advisers appointed in connection with our business;
- MOMA's third-party service providers, third-party management companies, business partners, contractors, sub-contractors and/or authorised or contracted third parties, in relation to providing you with related products and services;
- MOMA's appointed service providers in relation to our delivery services;
- any persons, government agencies, statutory authorities and/or industry regulators, where we are compelled or required to do so by law;
- your present and past employers;
- education and training institutions and examining bodies;
- employment and recruitment agencies; and
- other parties in respect of whom you have given your express or implied consent.
4. Security
MOMA takes reasonable steps to ensure the security and confidentiality of your personal data. We employ procedural, physical and technological security measures to protect your personal information against loss, theft and destruction, as well as unauthorised access, disclosure, copying, use or modification.
5. Data transfer
We may transfer personal data which we hold about you to our strategic business partners or authorised or contracted third-party service or product providers, within or outside Malaysia. You understand and consent to us transferring your personal data to these parties in such instances. On this website, some providers (for example Google and Meta) process data on servers outside Malaysia; where that happens, transfers rely on the provider’s safeguards and standard contractual terms.
6. Accuracy and correction of your personal data
MOMA strives to maintain complete, current and accurate personal data. You are responsible for ensuring that the personal data you provide to MOMA is accurate, complete, not misleading and up to date. Where you establish that the personal data we hold is inaccurate, incomplete, misleading or out of date, you may contact us and bring it to our attention, and we will promptly rectify or correct the records as necessary.
If you provide MOMA with personal information about someone other than yourself (for example, a referee or guarantor), you are required to inform that individual that you are providing their personal information to MOMA and to obtain their consent.
Where personal data is necessary for us to provide you with products and/or services, any failure to provide it may affect our ability to do so (including the non-provision of the products and/or services), and we are not liable for any loss or damage resulting directly or indirectly from such effects.
7. Access
You may at any time make inquiries or complaints, request access to or correction of your personal data, or ask to limit the processing of your personal data, by writing to MOMA customer support at:

8. Erasure of personal data
Any personal data retained by us is destroyed and/or deleted from our records and systems when it is no longer required for the purposes described above. Analytics data from this website is retained for up to 24 months; enquiry correspondence is kept only as long as needed to deal with your request and meet legal obligations.
9. Technical information & cookies
We may also collect technical, non-personal identification information — such as browser name, IP address, pages visited, how long various features are used, and other statistics — for analysis and evaluation, to help us improve our websites and the services and products we provide. This data is not used in association with any other personal information. Our websites use cookies to enhance the user experience; the cookies on this site are:

Nothing non-essential loads until you choose “Accept” on the consent banner. If you decline, we set only the strictly-necessary moma_consent cookie that records your choice. We do not use local storage or other browser-storage APIs for tracking. The only providers involved are Google (Analytics) and Meta (the Meta Pixel, for Facebook and Instagram measurement), and only when you have accepted cookies; they process data on our behalf.
10. Links to external websites
Our websites may contain links to external websites that do not belong to MOMA. If you visit a linked external website, you should review its privacy policy. We are not responsible for the policies and practices of other companies, and any information you submit to them is subject to their privacy policies.
11. Your consent
By providing your personal data to us, you understand, consent and agree to the collection and use of your personal data by us in the ways described in this statement. In addition, where you have provided their details for such purposes, you consent to your referees, the institutions where you have studied, the professional bodies where you received your accreditation, and your employers disclosing your personal information to us.
Your rights
Under Malaysia’s Personal Data Protection Act 2010 — and, where they apply, Singapore’s PDPA and the EU/UK GDPR — you may ask to access, correct or delete your personal data, withdraw consent, or object to processing. To exercise any of these, email hello@momawater.com. You may also withdraw analytics consent at any time by declining cookies. If you believe we have not handled your data properly, you may complain to the relevant data-protection authority.
Children
This site is intended for a general audience and is not directed at children. We do not knowingly collect data from children.
Changes
We may update this statement from time to time; the date above shows the latest version. Material changes will be reflected here.
